Middels het Sectorplan Rechtsgeleerdheid investeert Nederland in vernieuwend empirisch-juridisch onderzoek en academisch talent. Aan de verschillende rechtenfaculteiten worden nieuwe onderzoeksgroepen ingericht, waarin veelal juristen en sociale wetenschappers bijeenkomen en (interdisciplinair) samenwerken. Onderzoekers van de Universiteit Leiden, Erasmus Universiteit Rotterdam, Rijksuniversiteit Groningen, Universiteit Utrecht en de VU Amsterdam werken samen aan het vormgeven en versterken van de almaar groeiende nationale en internationale wetenschapsagenda op het gebied van empirisch-juridisch onderzoek.
Het onderzoek binnen dit speerpunt is divers, in termen van zowel onderwerpen als de gehanteerde empirische onderzoeksmethoden. Centraal staat het empirisch onderzoeken van juridisch relevante vragen. Aan de hand van zowel kwantitatieve als kwalitatieve methoden doen wij onderzoek naar law in action en wat werkt. Empirisch onderzoek naar de (door)werking van het recht in de maatschappij levert fundamentele kennis op over (gedrags)veronderstellingen die ten grondslag liggen aan de verschillende rechtsregels en kan bijdragen aan het behalen van de doelen van de wetgever.

abstract = {Based on previous research on enforcement of social security in the Netherlands, we introduced the perspective “smart enforcement” (Hertogh, Bantema, Weyers, Winter & De Winter). When we ignore other factors and circumstances, we see that the (experienced) sanctioning is not, but the (experienced) persuasion is related to compliance. The extent to which beneficiaries comply with the obligations of their benefit depends on the perceived chance of being caught and the profit that is expected from the violation. Our research shows that the motivational postures of beneficiaries are important for compliance. The individual profile of beneficiaries can be mapped based on five "motivational postures" distinguished by Valerie Braithwaite: commitment, capitulation, resistance, disengagement and game playing. The first two attitudes are characterized by a positive attitude toward the law and law enforcement, and the remaining three attitudes are characterized by an increasing negative attitude. A person can have multiple motivational postures at the same time. "Commitment" and "capitulation" have a positive relationship with compliance, while "resistance," "disengagement" and "game playing” are negatively related to compliance. The level of compliance in social security benefits not so much from "more" enforcement, but from "smarter" enforcement. In other words, the effectiveness of enforcement in social security is not only determined by tougher or softer measures, but also by the extent to which the enforcement style is tailored to the specific backgrounds and expectations of the beneficiary. The principle of "smart enforcement" is that the individual profile of the beneficiary must be taken into account as much as possible when setting up the enforcement relationship. Enforcers should be able to match their behavior to the profile of beneficiaries. To help employees determine the profile of their clients, we developed an electronic analysis tool (the textquoteleftprototypetextquoteright). We tested the prototype at one social assistance agency in the Netherlands. After the test-phase, we interviewed beneficiaries and employees about their experiences with the prototype.},

abstract = {The principal objective of this research is to audit the limits set by international and EU law in the context of EU Member Statestextquoteright exclusive competence to deal with citizenship/nationality issues, especially how they address the most important problems related to access to and loss of citizenship, statelessness, minority rights and non-discrimination. The adequacy of existing regulations was tested with the example of Estonia, an EU Member State with a diverse population and a persistent mass statelessness problem. The study demonstrates that the rules that exist at the international level are clearly insufficient: the contemporary concepts of citizenship does not on its own imply adequate access to the textquoteleftright to have rightstextquoteright; international law does not offer a comprehensive solution to the problem of access to citizenship for vulnerable groups in the population, including stateless people; and the principle of proportionality required by EU law in matters of EU citizenship at the national level can only be implemented with great difficulty. As for Estonia, contrary to the official, legalist rhetoric and references to the principle of state continuity, the problem of statelessness is nothing more than the result of political decisions made in the early 1990s. Naturalisation requirements in Estonia adversely affect the huge indigenised Russian-speaking community and even amount to the ethnic or language discrimination of its members.},

abstract = {The Alternative War on DrugsDrug Evictions, Cannabis Regulation and the Legal Consequences of Adapting to the Limitations of Criminal Law in the Field of Drug ControlVarious scholars affirm that the criminal justice system has failed both to reduce drug consumption and to curb drug-related crime; they argue that the war on drugs is waning, and sputtering to close. However, Bruijn's research shows that the war on drugs changing, rather than waning. Countries have adapted to the constraints of the criminal justice system. Bruijn's thesis focuses on two of these adaptations: 1) the (re)regulation of cannabis in Canada and the Netherlands; and 2) the use of eviction to fight drug-related crime in the Netherlands and the United States. Bruijn used three different types of research methods to study these two developments: doctrinal legal research methods, comparative legal research methods and quantitative research methods.In her dissertation, Bruijn shows that the limitations of the criminal justice system have led several jurisdictions to liberalise or legalise the use, possession, sale and production of cannabis. In 2018, Canada became the first G7 country to officially allow the regulation of the entire cannabis market. The Netherlands drew away from a punitive prohibition style decades ago, by tolerating small-scale retail of cannabis in coffeeshops. The Dutch government recently decided to start an experiment with regulated cannabis cultivation in 2021. The UN drug conventions no longer appear to be an obstacle for both countries. To date, both countries have received international criticism for their liberal cannabis policies, but there have been no real repercussions.Another way of dealing with the failing criminal justice system is to use administrative and private law. Behind drug activities lies not only the threat of a criminal sanction, but also the threat of losing of onetextquoterights home. A major advantage of the use of administrative and private law is that these areas of law provide fewer legal safeguards than criminal law. Bruijn's research shows that the protection offered to evictees in court cases about drug evictions in the Netherlands and the US, does not compensate this lack of legal safeguards. In fact, both the right to a fair trial and the right to housing are under severe pressure. The Netherlands and the US have adapted their fight against drug-related crime to the limitations of criminal law, but Bruijn's research shows that legal protection offered by human rights has not (yet) adapted to this alternative war on drugs.},

The TARR Model provided an important analytical framework, whereas the UN Basic Principles and Guidelines on the Right to a Remedy and Reparation constituted a significant yardstick for this research. While acknowledging the unprecedented right of the victims of the most serious international crimes to reparations, this research also exposes the practical challenges and shortcomings faced by the application of the internationalised human rights standards of victimstextquoteright right to reparations in cases of mass violations of human rights.Yet, it also recognizes that the measures put in place by the government of Rwanda to address the consequences of the genocide against the Tutsi do fit within the scope of the measures of restitution, rehabilitation and satisfaction, as provided in international law, and emphasizes their adaptation to local realities and experiences.},

abstract = {This book addresses the problem of linking high-level accused to Sexual and Gender-Based Crimes in international criminal law and focuses on the theoretical and practical perspectives taken by the ICTY, ICTR, and ICC. It seeks to answer the research question: How can and should high-level officials be investigated and prosecuted for their role in the commission of Sexual and Gender-Based Crimes? The research project was focused on the forms, types, and amount of evidence used to prove the role of these high-level accused in the commission of the crimes by the rank-and-file soldiers. These high-level accused are usually removed from the crime scenes and the international criminal courts and tribunals rely on the individual criminal liability theories enshrined in Articles 7 ICTY Statute, Article 6 ICTR Statute, and Articles 25 & 28 Rome Statute to connect them to the atrocities committed on the ground. The study examined 100 individual cases of Sexual and Gender-Based Crimes from the ICTY, ICTR, and ICC and revealed that most times the evidence was sufficient to prove the Sexual and Gender-Based Crimes, but it became much harder for the prosecutor to gather evidence to prove the links to the high-ranked accused and the modes of liability charged. The study concludes with concrete recommendations on how to gather linkage evidence effectively and use the modes of liability accurately to reflect connections between Sexual and Gender-Based Crimes, the broader context, and the accusedtextquoterights role.},

abstract = {In policy research, the search for the correct balance between proximity and independence has never been easy. Policymakers need proximity to the research in order to ensure that it is relevant. Yet, there are also concerns about the rigour of research. To analyze this relationship in more detail, this paper focuses on the textquoteleftextreme casetextquoteright of the WODC in the Netherlands, an internal but formally independent research unit of the Dutch Ministry of Justice and Security. Research methods include semi-structured interviews and a survey (N = 673). We conclude that government leans on WODC researchers in all phases of the policy research process. In most cases, WODC researchers successfully resist pressure from policymakers, yet continuing pressure may easily lead to research methods, conclusions and press releases being altered for policy reasons. Finally, there are general lessons drawn from the WODC case that will assist in achieving a good balance between proximity and independence in policy research.},

abstract = {Ärticle 5 of the Unfair Contract Terms Directive requires terms in consumer contracts to be textquoteleftdrafted in plain, intelligible languagetextquoteright. The European Court of Justice has ruled on several occasions that transparency essentially equates to textquoteleftforeseeabilitytextquoteright: if a termtextquoterights legal consequences can be foreseen by the average consumer, it is transparent. Foreseeability therefore requires, so we hypothesise, that the legal effects of terms are comprehensible. Terms are comprehensible if they are plain and intelligible, which means that they are readable. Courts struggle with this transparency test and some authors call for an empirical approach. We wonder whether empirically tested readability formulas could help legal professionals answer this call, albeit in a more efficient, less time-consuming way. An obvious method to assess foreseeability would consist in the application of a readability formula. In this paper we focus on readability formulas, more specifically on the Flesch readability formula. We also devise our own formula, one that is specifically geared towards legalese. We then test both formulas – the Flesch formula and our own – empirically in order to evaluate their usefulness. Since we wish to address legal effects in a broad sense (without restricting ourselves to financial consequences) we opted to assess the foreseeability of general terms and conditions in gaming contracts. These terms and conditions have recently been criticised for being detrimental to the consumer (in the French Steam-case). Our main findings are threefold. Our first conclusion is that the Flesch readability formula cannot indicate whether terms are foreseeable. Second, our revised formula also failed the test. There is no correlation between readability as assessed by either formula and the actual comprehensibility of the terms. Third, we found that the legal effects of the terms and conditions in gaming contracts we presented to our participants (96) are understood well and are thus foreseeable."},

Online businesses collect a wealth of data on customers, often without properly informing them. Increasingly, these data can be used for behavioral price discrimination. In this two-study article, we explore how consumers would respond if businesses were compelled to disclose their use of discriminatory behavioral pricing techniques. Using different disclosure frames, we examine the effects of disclosure on purchase intention and purchase probability. The findings indicate that specific disclosure frames affect purchase intentions. Furthermore, we find that a disclosure frame that is more in line with a consumer’s self-interest increases purchase intention. Specifically, the frame indirectly influences intention to purchase through its effect on the perception that the use of behavioral pricing information serves self-interest. In this way, our study draws attention to a potentially unanticipated effect of regulatory intervention. Implications for future research and legal policy are discussed, focused on the need to design and empirically test the effectiveness of disclosures online.},

abstract = {The paper uses non-experimental longitudinal data to study the effects of participation in the Youth Guarantee programme aimed at fighting youth inactivity in the European Union territory. Particularly, this analysis questions the value of active labour market policy as a valid instrument to help individuals otherwise isolated from the labour market and, thus, at risk of deterioration of human capital overcome their condition of occupational inactivity. A difference-in-differences model is exploited in this regard to investigate whether there exists an advantage for participants of the Youth Guarantee in terms of employment and job stability. Results show that participants are 7.4 and 4.4 percentage points more likely to, respectively, become employed and be offered an open-ended contract. An assessment of profiling is also provided.},

abstract = {Qualitative interviews with one hundred defendants in Dutch criminal cases examine whether perceived procedural justice is a relevant concern for defendants, and, if so, which procedural justice components they refer to. The study provides a point of epistemological departure from the quantitative studies dominating the field, as it assessed which components of procedural justice (if any) respondents put forward themselves rather than asking about predetermined procedural justice components. The large majority of respondents mentioned procedural justice issues themselves, and six components were at the core of their procedural justice perceptions: (1) information on which decisions are based, (2) interpersonal treatment, (3) due consideration, (4) neutrality, (5) voice, and (6) accuracy. Although these procedural justice components largely correspond with the literature, respondents thus mentioned some components more often, and others less often, than the literature would suggest. In particular, neutrality plays an important role in the Dutch legal context examined here.},

abstract = {Abstract Despite active labour market policies being implemented to increase the skills and job opportunities of the unemployed, the number of people who do not participate in training and other services of job orientation remains high. By providing a model that studies the decision-making process of a potential participant, we hypothesise there is a behavioural motive behind it. An experiment is carried out to account for both the individual's preference and the social expectations of agents such as the government and her peers with respect to active occupational measures. Findings show that young unemployed individuals are significantly influenced by their peers when deciding whether to participate or not in a training programme. Particularly, negative expectations from the peers cause unemployed potential participants in a within- and between-subjects experiment to be, respectively, 33 and 42 percentage points less likely to take part in job training.},
